      Child Abduction

      Child Abduction Ministry of Justice Iceland is a party to two international conventions intended to ensure the interests of children who have been wrongfully removed from one member state to another. These are the European Convention on Recognition and Enforcement of Decisions concerning Custody of Children and on Restoration of Custody of Children which was concluded in Luxembourg on 20 May 1980 (the European Convention), and the Hague Convention on the Civil Aspects of International Child Abduction, concluded on 25 October 1980 (the Hague Convention).       Adoption Ministry of Justice The Ministry of Justice is responsible for legislation and regulations concerning adoptions in Iceland, policymaking, accreditation and supervision of adoption organizations. The Ministry is the Central Authority in Iceland under the Hague Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption and supervises the implementation of Convention in Iceland as well as accredited adoption organizations. It is also an appeal instance when the District Commissioner in the Capital Region, which is an administrative authority under the Ministry of Justice, has rejected an application for domestic adoption or an advance approval for adoption of a foreign child

      The Icelandic Ministry of Welfare considers it urgent to present the following facts due to incorrect and misleading information which has repeatedly been spread abroad concerning the birth of children in Iceland with Down syndrome. Among the misconceptions which have been promoted is the claim that the policy has been adopted by the Icelandic authorities of preventing mothers from giving birth to children with Down syndrome. These statements are not based on facts, and furthermore makes serious accusations which cannot simply be ignored.

      <p>The Icelandic Act on Maternity/Paternity and Parental Leave underwent significant changes in the year 2000. The leave was extended from six months to nine, parents who were active in the labor market were paid 80% of their average salaries during the leave and the payments were to come from a specific fund, financed through an insurance levy.</p>

      Further details regarding the Hague Convention Ministry of Justice Child Abduction According to the Hague Convention and the Act on Recognition and Enforcement of Foreign Decisions concerning Custody of Children, Return of Abducted Children etc. , No. 160/1995, the removal or the retention of a child is to be considered wrongful where it is in breach of rights of custody attributed to a person, an institution or any other body, either jointly or alone, under the law of the State in which the child was habitually resident immediately before the removal or retention; and at the time of removal or retention those rights were actually exercised, either jointly or alone, or would have been so exercised but for the removal or retention
